A Breakdown Of Sensible Plans
“You wanna hold us up, we’ll hold you up!” Councilman Marcus Brown told two municipal lawyers Tuesday during a tension-filled ordinance committee meeting, which Brown co-chaired. That committee has launched an aggressive — and at times seemingly unwieldy — probe into the city’s longtime use of private collection attorneys, the courts and property foreclosures to go after bills owed the Water Pollution Control Authority. The council hopes to reform that process and set up an improved mediation program for homeowners who have fallen too far behind. But the sniping between some council members and municipal lawyers who, ideally, are supposed to be working together — the City Attorney’s Office is legal counsel to the council — has escalated to the point of disfunction. “I love the way they talk to us like we’re animals — dogs on a leash,” Councilwoman Eneida Martinez snapped after one veteran municipal lawyer, Mark Anastasi, tried to correct her Tuesday on a procedural matter. “Don’t characterize my language,” Anastasi shot back. Councilman Peter Spain referred to Anastasi and his colleague, municipal lawyer Tyisha Toms, as “our illustrious attorneys.” Toms indicated she did not appreciate Spain’s sarcasm, and Spain responded: “It’s well earned. It’s well deserved.” Ordinance committee members Tuesday accused the City Attorney’s staff of taking too long to respond to requests for legal opinions and information about the WPCA collection process and other matters, slowing the council’s work. So Brown, Martinez and others on the ordinance committee will ask the full council Monday to place a 180 day moratorium on allowing private collection attorneys to move ahead with foreclosures to compel payment of overdue WPCA bills. “So you all will see we’re very serious about trying to help people,” Councilman Ernest Newton said. The move could also cripple WPCA collection efforts.
